Practice Focus

Advise and represent mining companies, oil and gas producers, petroleum refiners, industrial manufacturers, electricity providers, wastewater treatment facility operators, municipalities, federally recognized Indian tribes, real estate developers and financial institutions in environmental and natural resources permit proceedings, litigation and commercial transactions impacted by environmental laws.

• Perform due diligence and regulatory reviews and negotiate contract provisions allocating environmental compliance responsibilities and liabilities to facilitate mergers, acquisitions, divestitures, real estate transactions and bankruptcy estimation proceedings.
• Negotiate with government agencies regarding air pollution control permits, surface water and groundwater discharge permits, waste management permits, mineral development and mine reclamation permits, voluntary and responsible party remediation, pipeline and transmission line rights of way, federal land exchanges and environmental legislation and rulemaking.
• Defend against environmental enforcement actions, litigate indemnity claims and prosecute judicial reviews of agency decisions under the federal Clean Air Act, Clean Water Act, Superfund Laws, General Mining Laws, National Environmental Policy Act, Endangered Species Act and state regulations.
